I'd like to place a pondless waterfall against the fence with a stream coming out toward viewer and to the right dieing into the catch, but continuing on as a dry creek bed following the natural swale through the yard. This is where water from the uphill neighbor's yard drains and I'm wondering how to do this so that it doesn't dam up their runoff. It can be a real stream if we get a couple or three inches of rain quickly. Thanks

My first suggestion would be to pull the feature off the fence approximately 3 feet or so. This will provide you an area to plant behind the waterfall to mask the fence and to also allow you to grade you property in a fashion that will let the run off from your neighbor run behind the waterfall.
Additionally, you could grade the property so that the run off from the neighbor's property might run into the area of dry creek bed you are going to create.
